These terms govern your use of www.finvisor.global and www.finvisor.ie (the "Site"), which are operated by Finvisor Limited ("Finvisor", "we", "us" or "our"), a company incorporated in Ireland with its registered office at Owlpen, The Mayne, Clonee, Co. Meath, D15 P656, Ireland. By using the Site you agree to these terms. If you do not agree, please do not use the Site.

1. Scope

These terms apply to your use of the Site and to the briefings, insights and other materials made available through it. They do not govern the provision of consulting, audit, assurance or software services by Finvisor. Those services are provided only under a signed work order, engagement letter, platform services agreement or other written agreement, and in the event of any conflict that agreement prevails.

2. Information, not advice

The content of the Site, including regulatory briefings, articles, downloadable documents and descriptions of our services, is provided for general information only. It reflects our understanding of the law and regulatory practice at the date of publication, which may change. It does not constitute legal, regulatory, accounting, tax or investment advice, does not create a client relationship with Finvisor, and should not be relied upon as a substitute for advice specific to your circumstances. Regulatory outcomes, including authorisation decisions, are matters for the relevant competent authority, and no statement on the Site should be read as a guarantee of any regulatory outcome.

3. Regulatory status

Finvisor Limited is a regulatory consultancy. It is not authorised or regulated by the Central Bank of Ireland, the Financial Conduct Authority, the Bank of Lithuania or any other financial services regulator, and it does not provide regulated financial services. Where individual members of our team hold approved or controlled-function roles at regulated firms, they do so in their personal capacity under appointment by those firms.

4. Intellectual property

The Site and its content, including text, briefings, graphics, logos, methodologies, assessment frameworks and software, are owned by or licensed to Finvisor and are protected by copyright, trade mark and other intellectual-property laws. You may view, download and print content for your own internal business use, provided you keep all copyright and proprietary notices intact and do not modify it. You may not reproduce, republish, distribute, sell or otherwise exploit any content for commercial purposes, or use it to train machine-learning models, without our prior written consent. "Finvisor" and the Finvisor logo are trade marks of Finvisor Limited.

5. Acceptable use

You agree not to use the Site in any way that breaches applicable law; to attempt to gain unauthorised access to the Site, its servers or any connected system; to introduce malicious code; to scrape or harvest data from the Site by automated means; or to submit through our forms any content that is false, misleading, defamatory or infringes the rights of others.

6. Forms, enquiries and subscriptions

Information you submit through the Site's contact, briefing-request and subscription forms is handled in accordance with our Privacy Policy. Submitting a form does not create an engagement or any obligation on Finvisor to provide services. Please do not send confidential or regulator-sensitive information through the Site forms; we will agree a secure channel with you once an engagement is under discussion.

7. Third-party links

The Site may contain links to third-party websites, including regulators' websites and LinkedIn. These are provided for convenience. We do not control those sites and accept no responsibility for their content or their handling of your personal data.

8. Availability and changes

We aim to keep the Site available but do not guarantee uninterrupted access. We may suspend, withdraw or change the Site or any content at any time without notice. We may update these terms from time to time; the current version is the one published on the Site, and the date at the top shows when it was last changed.

9. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded. Subject to that, and to the extent permitted by law, Finvisor excludes all implied conditions, warranties and representations in relation to the Site and its content, and will not be liable for any loss or damage, whether direct, indirect or consequential, arising from your use of or reliance on the Site or its content. Liability for services we provide under a written agreement is governed by that agreement.

10. Privacy and cookies

Our use of personal data is described in our Privacy Policy and our use of cookies in our Cookie Policy. Both form part of these terms.

11. Governing law

These terms, and any dispute or claim arising out of or in connection with them or your use of the Site, are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction, except that nothing in this clause prevents you, as a consumer, from relying on mandatory protections available in your country of residence.
